Private Sector Development: Legal and regulatory framework
The private sector can alleviate poverty by contributing to economic growth, providing decent work, empowering poor people to obtain proper services and consumer products, increasing choices and reducing prices.
Purpose of this paper
The purpose of this paper is to present the main principles of the legal and regulatory framework governing businesses in developing countries, to give an overview of current Dutch policy in this field and to identify priorities for the coming years.
The focus in this paper is on legal and regulatory reforms affecting private enterprises. This is only a subset of the regulatory environment relating to the broad scope of good governance. Other DDE working papers (on financial sector development and infrastructure) provide information on the regulatory environment for the financial and infrastructure sectors.
The structure of this paper is as follows:
• Chapter 2 explains why the legal and regulatory framework is important to growth and poverty reduction.
• Chapter 3 describes in some detail what the legal and regulatory framework entails, including the role of donors, and gives an overview of the recent debate.
• Chapter 4 provides a detailed overview of the Ministry’s present policies and programmes in this field.
• Chapter 5 looks at the implications for future policies and programmes.
• Chapter 5 deals with the Ministry’s knowledge and research strategy regarding the legal and regulatory framework theme.
